Terms & CONDITIONS

1. Engagement & Authority

Hit Point provides independent, senior-level consultancy. Frank Tamburin acts as an independent contractor, not an employee or agent. You represent that you have the authority to share the materials provided for review.


2. Intellectual Property (IP)

Your IP: You retain full and exclusive ownership of all game assets, scripts, decks, and narrative materials shared during our engagement. Materials shared for review purposes are deleted or returned upon request following the conclusion of the engagement. 

Hit Point IP: Hit Point retains ownership of its proprietary frameworks, methodologies, diagnostic tools, and training materials used during the delivery of the service. You are granted a non-exclusive license to use the outputs of the service for your specific project.


3. Confidentiality & NDAs

Confidentiality is a cornerstone of senior consultancy. All non-public information shared is treated as ‘Confidential’ by default. While Hit Point can provide a standard mutual NDA, we are also happy to review and sign your organization’s specific NDA prior to the commencement of work.


4. Exclusivity & Conflicts of Interest

Hit Point provides services on a non-exclusive basis and is free to provide services to other people, whether in the same industry or otherwise. Notwithstanding this, Hit Point will not accept a booking that creates a direct conflict with an existing client, or involves the use of privileged information from prior engagements. If a conflict emerges during an engagement, you will be notified immediately. Hit Point reserves the right to decline or cancel work where a conflict is identified (with a full refund issued for any undelivered sessions).


5. Payment

All Hit Point services are confirmed upon receipt of payment. Bookings are not confirmed until payment has been processed in full.


6. Cancellation & Rescheduling 

All sessions may be rescheduled with more than 48 hours notice via the booking link provided in your confirmation email, at no charge.

Cancellations made with more than 48 hours notice will be refunded in full, minus the original Stripe payment processing fee (typically 1.5% to 3.25%, depending on the card used). Cancellations made inside 48 hours of the scheduled session time are non-refundable, as the slot has been reserved exclusively and preparation time committed.

For Creative Lift Mentorship, individual sessions may be rescheduled with more than 48 hours notice. Monthly retainer fees are non-refundable once the billing period has commenced.

Hit Point reserves the right to reschedule sessions in exceptional circumstances. In such cases, clients will be offered the next available slot or a full refund.


7. Limitation of Liability

To the maximum extent permitted by law, Hit Point’s total aggregate liability for any claim or series of claims arising out of these services is limited to the total fee paid for the specific session or engagement in question. Hit Point is not liable for indirect or consequential losses (such as loss of profits or project funding).

You accept that Hit Point cannot guarantee the final commercial outcomes of any projects or deliverables and so has no liability for the same.


8. Governing Law

These terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
